This terms-of-service agreement is entered into between you and Altiris Productions LLC ("Company") DBA 3rdShiftVideo/Nookies. The following terms and conditions govern the use and access to the 3rdShiftVideo/Nookies websites, which includes: (1) nookies.com, shereacts.com, milfaf.com, edgequeens.com, clubtug.com, shadyspa.com, teasePOV.com, mylked.com, meanmassage.com, ebonytugs.com, teentugs.com, over40handjobs.com, seemomsuck.com, cumblastcity.com, familylust.com, petite18.com, handjobhubpremium.com, tugpass.com, finishhim.com and any sub-domains; (2) (collectively, the “Sites” or individually, a “Site”).

Before Subscriber’s transaction can be completed, Subscriber must read and agree to these terms and conditions. By applying for access and or services from this website, Subscriber is agreeing to these terms and conditions, and is agreeing to be legally bound by them. This agreement is subject to change at any time.

1. Subscriber data is for internal use only and will be treated confidential.
2. All transactions are SSL encrypted.
3. Subscriber's credit card will be billed immediately after purchase.
4. After purchase Subscriber will receive an email notification with all payment details. The contract is closed between customer and shop as soon as the order is submitted.
5. All orders will be processed immediately.
6. We recommend to print out the transaction data and Terms and Conditions and to keep them at an easily accessible place.
7. Prohibited for people under legal age in their respective country.
   
   

1. Age Restriction
NO PERSONS UNDER THE AGE OF EIGHTEEN (18) YEARS MAY DIRECTLY OR INDIRECTLY VIEW OR POSSESS ANY OF THE CONTENTS OF THE SITE (AS DEFINED BELOW), SUBSCRIBE TO THE SITE, OR PLACE ANY ORDERS FOR ANY GOODS OR SERVICES ADVERTISED AT OR IN THE SITE. YOU HEREBY AFFIRM AND WARRANT THAT YOU ARE CURRENTLY AT LEAST EIGHTEEN (18) YEARS OLD, THE AGE OF MAJORITY IN YOUR COMMUNITY, AND ARE CAPABLE OF LAWFULLY ENTERING INTO THE AGREEMENT

2. Description of Services
3rdShiftVideo will provide one access right to access the Site and its materials for which Subscriber is purchasing a membership.

3. Billing
Altiris.co, EPOCH.com, CCBILL.com or SEGPAY.com or Vendo.com may appear on Subscriber’s credit card, bank statement, or phone bill for all applicable charges. If Subscriber elects to use a checking account to purchase a subscription to this site, a debit will be executed on their checking account.

4. Payment / Fee
The Sites may have periodic subscription fees at the time of the initial enrolment for subscription. The member is responsible for such fees according to the terms and conditions of such Site.

5. Automatic Recurring Billing
In accordance with the terms and conditions of the Site subscription fees may be automatically renewed at or after the end of the original term selected, for a similar period of time and for a similar or different amount, unless notice of cancellation is received from the Subscriber. Unless and until this agreement is cancelled in accordance with the terms hereof, Subscriber hereby authorizes 3rdshiftvideo to charge subscriber's chosen payment method to pay for the ongoing cost of membership.

6. Electronic Receipt
Subscribers will receive an email receipt to their email provided upon initial subscription. Subscriber may request a copy of the account of charges of their membership to the Site and requests must be made directly to 3rdshiftvideo. To contact 3rdshiftvideo click CLICK HERE

7. Cancellation
At any time, and without cause, subscription to the service may be terminated by either: 3rdshiftvideo, the Site, or the Subscriber upon notification of the other by electronic or conventional mail, by chat, or by telephone. Subscribers are liable for charges incurred until the date of the termination.

8. Refund Policy
Refunds or credits will not be issued for partially used subscriptions or any record of log-ins to the site. Refunds and credits will not be provided for non-use or partial use of a membership through no fault of the Company. All refund requests are reviewed on a case by case basis. Approved refund and/or credit amounts will be made at management’s discretion. In the event a refund is approved, the funds will be applied back to the form of payment of the original transaction. No cash refunds, check refunds or bank transfer refunds. No refund can be made on Gift Cards.

30 Day Money Back Garantee

An unconditional 30-day money back guarantee will be issued due to the inability to deliver satisfactory services. As a part of our strive to achieve industry leading customer satisfaction, the customer will be refunded all charges made to their credit card  if you terminate your service within thirty (30) calendar days from your order date. This Money Back Guarantee period only applies to recurring memberships and trial memberships. The guarantee does not apply to accounts with non-use, misuse, and/or abuse of this agreement. Note - Subscribers are responsible for providing all personal computer and
communications equipment necessary to gain access to the Service. Access to
and use of the Service is through a combination of an ID and a password. Each
Subscriber must keep his password STRICTLY CONFIDENTIAL. Remember your
password! For security reasons, the Website will not release passwords for any
reason, except as may be specifically required by law or court order.
Unauthorized access to the Service is a breach of this Agreement and a
violation of law.

Copyright
Except for public domain material and electronic messages, all material
displayed on the Service is copyrighted and licensed by the Website and may
not be copied, or redistributed, in whole or in part, without the prior
written consent of, the Website unless otherwise clearly stated in this
Agreement.

9. The material on the Service is for the private, non-commercial enjoyment of
Subscribers only. Any other use is prohibited.

10. The Service enables Subscribers to share information with other
Subscribers. Subscribers agree not to submit, publish, or display on the
Service any defamatory, inaccurate, abusive, threatening, racially offensive,
or illegal material.

11. Subscribers agree not to engage in advertising to, or solicitation of
other Subscribers to buy or sell any products or services through the Service
without prior written consent. Subscribers are responsible for information
they send, or display through the Service even if a claim should arise after
termination of service.

12. There are no facilities provided by the Service for sending or receiving
private or confidential electronic communications. All messages shall be
deemed to be readily accessible to the general public. Do not use the Service
for any communication for which the sender intends only the sender and the
intended recipient(s) to read. Notice is hereby given that all messages
entered into this Service can and may be read by the operators of the Service,
whether or not they are the intended recipient(s).

13. Notices by the Website to Subscribers may be given by means of electronic
messages through the Service, by a general posting on the service, or by
electronic or conventional mail. Notices by Subscribers to the Website may be
given by electronic messages or mail, unless otherwise specified in the
Agreement. All questions, complaints, or notices to the Website, by means of
electronic message must be sent to Customer Service. All questions regarding
new Website memberships, by means of electronic message should be sent to
Customer Service.

14. The subscriber hereby warrants and represents that he or she is over the
age of 18 (21 years in some locales), and in all respects is qualified and
competent to enter into this agreement and consents to the viewing of adult
material without being in violation of any local laws.

15. Website Subscribers agree upon joining to have their Email address added
to our member newsletter mailing list, and may possibly receive special offers
from us. However we do have a strict policy against all types of unsolicited
email.

REPORT ABUSIVE OR ILLEGAL CONTENT

If you believe that some content is not meeting legal requirements, or if you feel you are the victim of, or come across content that is constituting:

• Non-consensual production and/or distribution of your image (including but not limited to: blackmail, exploitation, revenge porn);
• Content that reveals personally identifiable information (including but not limited to : name, phone number, address, IP address); OR
• Otherwise abusive and/or illegal content

Complaint Policy
The Company has a complaint process that allows you or anyone to report to the Company any conduct of a user that may be illegal or that otherwise violates this agreement. If you have a complaint, please send your complaint to support@3rdshiftvideo.com, including your name, address, contact details, a description of your complaint. If you cannot contact the Company by email, please write to the Company at the address identified below. After receiving your complaint, (a) the Company will take those steps as the Company considers to be appropriate to investigate your complaint within a timeframe that is appropriate to the nature of your complaint (the Company will review and resolve all reported complaints regarding content that may be illegal or otherwise violate credit card association standards within seven business days); (b) if the Company requires further information or documents from you, the Company will contact you to let you know; and (c) the Company will in good faith take those actions as it considers appropriate to deal with the issue that your complaint has raised. The Company is not required to inform you of the outcome of your complaint. You state that you will not make any complaint that is wholly unjustified, abusive, or made in bad faith. If the Company determines that you have breached this warranty, the Company may suspend or terminate your account.

Termination
We reserve the right to terminate or restrict your access to or use of the Services, without notice or liability, for any or no reason whatsoever.

Age of Majority
You represent and warrant you are at least 18 or 21 years of age, depending on the age of majority in your jurisdiction, and that you have the legal capacity to enter into this Agreement. If you are not at least 18 or 21 years of age, depending on the age of majority in your jurisdiction, you must exit the SITE immediately and may not use or access the SITE or print or download any Materials from them. You may be asked to verify your birth date on the Birth Date Verifier™ form as a condition of entry onto the SITE, pursuant to 28 U.S.C. § 1746. You agree not to bypass any security and/or access feature on this SITE. Additionally, the SITE does not assume any responsibility or liability for any misrepresentations regarding a user's age.

Force Majeure
SITE shall not be responsible for any failure to perform due to unforeseen circumstances or to causes beyond our reasonable control, including but not limited to: acts of God, such as fire, flood, earthquakes, hurricanes, tropical storms or other natural disasters; war, riot, arson, embargoes, acts of civil or military authority, or terrorism; fiber cuts; strikes, or shortages in transportation, facilities, fuel, energy, labor or materials; failure of the telecommunications or information services infrastructure; hacking of third-parties, SPAM, or any failure of a computer, server or software, for so long as such event continues to delay the SITE's performance.

No Child Pornography
You understand that all models appearing on this SITE are, and were at the time of all recorded images, at least 18 years of age, and that our SITE contains no child pornography. If you seek any form of child pornography, you must exit this SITE immediately. You acknowledge that all Materials on the SITE are protected by the First Amendment. We take a strong and definite stand against child pornography and only allow images and Materials that are protected by the First Amendment.

If you identify any images, real or simulated, depicting minors engaged in sexual activity within the SITE, please report the images to the SITE. Include with your report any appropriate evidence, including the date and time of identification. All reports will immediately be investigated and the appropriate action will be taken. We enthusiastically cooperate with any law-enforcement agency investigating child pornography.

"OPT-IN" & "OPT-OUT" AND USER COMMUNICATION

Subscriber's expressly and specifically acknowledges and agrees that his email address or other means of communicating with subscriber may be used to send him offers, information or any other commercially oriented emails or other means of communications. More specifically, other offers may be presented to the subscriber via email campaigns or other means of communications with a pre-selected preference or choice. If the subscriber does not deselect the pre-selected preference of choice (i.e. "OPT-OUT" of the offer) then the site may transfer the subscriber's personal profile information to the third-party service or content provider making the offer. If the subscriber deselects the pre-selected preference then no personal information about the subscriber may be disclosed to any third-party service or content provider.

Notice of Claimed Infringement

The SITE respects the intellectual property of others, and we ask our users to do the same. We voluntarily observe and comply with the United States' Digital Millennium Copyright Act. If you believe that your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please provide SITE's Designated Copyright Agent the following information:

Governing Law

These Terms and Conditions and all matters arising out of or otherwise relating to these Terms and Conditions shall be governed by the laws of the State of Florida, excluding its conflict of law provisions. The parties agree that the United Nations Convention on Contracts for the International Sale of Goods is specifically excluded from application to these Terms and Conditions. The parties hereby submit to the personal jurisdiction of the state and federal courts of the State of Florida. Exclusive venue for any litigation or arbitration permitted under this Agreement shall be with the state and federal courts located in Hillsborough County, Florida.

Disclaimer of Warranty
YOU EXPRESSLY AGREE THAT USE OF THE SITE OR ANY OF THE MATERIALS CONTAINED THEREIN IS AT YOUR OWN AND SOLE RISK. THE SITE AND ALL MATERIALS CONTAINED THEREIN ARE PROVIDED 'AS IS' THAT MAY MANIFEST CONTAMINATING OR DESTRUCTIVE PROPERTIES. SITE DOES NOT ASSUME ANY RESPONSIBILITY OR RISK FOR YOUR USE OF THE INTERNET. SITE MAKES NO WARRANTY REGARDING ANY GOODS OR SERVICES PURCHASED OR OBTAINED THROUGH THE SITE OR ANY TRANSACTION ENTERED INTO THROUGH THE SITE AND IS NOT RESPONSIBLE FOR ANY USE OF CONFIDENTIAL OR PRIVATE INFORMATION BY SELLERS OR THIRD PARTIES. SITE OWNER MAY CHANGE ANY OF THE INFORMATION FOUND AT THIS SITE AT ANY TIME WITHOUT NOTICE INCLUDING THE TERMS OF SERVICE WITHOUT NOTICE.
